Terms & Conditions

Purpose

These Terms & Conditions govern the contractual relationship between Hélène Gautier, professional photographer, and her clients for any photography service.

Booking and deposit

Any booking is confirmed by signing a quote and paying a 30% deposit of the total service fee. The balance is due no later than the day of the session.

The date is reserved only upon receipt of the deposit and the signed quote.

Cancellation

In the event of cancellation by the client:

— More than 90 days before the session: the deposit is refunded in full.

— Between 30 and 90 days: the deposit is retained as compensation.

— Less than 30 days: the full amount becomes due.

In the event of force majeure (accident, death…) preventing the photographer from carrying out the session, she undertakes to arrange a replacement by a professional partner photographer under the same conditions. If this is not possible, the deposit paid is refunded in full.

Copyright and usage rights

Photographs taken remain the intellectual property of Hélène Gautier. The client is granted a personal, non-commercial licence to use the delivered images.

Any commercial use, press publication or transfer to third parties requires prior written agreement and will be subject to additional billing.

Hélène Gautier reserves the right to use photographs for promotional purposes (website, social media, portfolio), unless the client expressly objects in writing before the session.

Photo delivery

Photographs are delivered via a secure download link or the private client space. Delivery timescales are specified in the quote.

Photos are selected and edited by the photographer. No raw (RAW) files will be provided.

Liability

In the event of unforeseen technical failure (equipment, storage media), Hélène Gautier's liability is limited to a refund of the amounts received. She cannot be held responsible for circumstances beyond her control (weather conditions, venue access, behaviour of those being photographed).

Applicable law

These Terms & Conditions are governed by French law. In the event of a dispute, an amicable resolution will be sought first. Failing that, the French courts shall have exclusive jurisdiction.
